“Unfolding the Knowledge & Building Skills of People & Organizations”
There is no doubt that the knowledge of labour laws is very important to the practicing managers in the field of IR / HR but case law is equally important through which the basic law is interpreted and acted upon. The knowledge of Labour Laws would be incomplete without the knowledge of case law based on the judicial pronouncements of the highest court that is Supreme Court of India and High Courts established in various states. You may be aware that various High courts and the Supreme Court of India have delivered a few landmark judgements which have many implications and have established the precedents and therefore understanding of such judgements is quite important.
At times different High Courts and Benches of Supreme Court in different cases deliver judgments which do not same to be in accordance with the view taken by the same court earlier which creates the confusion in the minds of practicing managers. The objective of the workshop is to provide clarifications and impart knowledge of the latest judgements which is indicative of the latest trends of judgements on Labour issues in the changed competitive market driven economy in the era of globalized international trade.
The study of the recent judgements of the Supreme Court & High Courts reveals that there has been a paradigm shift in the approach of Indian Judiciary in the matter relating to the engagement of Contract Labour, Discipline and Disciplinary Procedure, Service Contract and Standing Orders, Compliance of Principle of Natural Justice, These judgements, may help in bringing flexibility, discipline in Industry and maintaining work culture in spite of the main Acts having remained largely unchanged.
